Concept Australia collects personal data to carry out its functions as a migration agent including processing new applications, dealing with enquiries on your behalf: examples include:

Storage and security of your personal information

Concept Australia is committed to maintaining the confidentiality of the information that you provide and will take all reasonable precautions to protect your personal information from unauthorised use or alteration. We may store your personal information both electronically (on our computer systems) and in hard-copy form.  It is outside our control how any of the assessing authorities, state governments or Department of Home Affairs store your information.

What is GDPR?

GDPR stands for General Data Protection Regulation and replaces the previous Data Protection Directives that were in place. It was approved by the EU parliament in 2016 and comes into effect on 25th May 2018.

GDPR covers personal data that relates to individual persons. GDPR states that personal data should be processed ‘fairly and lawfully’ and ‘collected for specified, explicit and legitimate purposes’. Concept Australia is committed to protecting the rights and freedoms of individuals with respect to the processing of clients and staff personal data.

GDPR states that individuals have 7 rights in respect of their personal data

1. The right to be informed

Concept Australia processes personal data about clients. When we receive an enquiry via our website we collect some or all the following information:

  • Name
  • Date of birth
  • Telephone number
  • Email address
  • Postcode
  • Nominated occupation and details of employment history
  • Marital status
  • Health and Character
  • Details of qualifications

    This data is required by Concept Australia to conduct our business of making an initial assessment to determine your potential visa eligibility. This information is stored electronically and treated as highly confidential.

Once an applicant becomes a client of Concept Australia, we gather various personal documents regarding the client which are stored electronically and in some cases in hard copy form.

2. The right of access

At any point an individual can submit a request for their data and Concept Australia will be required to provide a response within one month. Concept Australia has the right to refuse a request, but we will inform the individual of the reasons for the rejection. The individual will then have the right to complain to the Information Commissioner’s Office if they are not happy with the outcome of their request

3. The right of erasure

The Code of Conduct published by the Migration Agents Registration Authority (MARA) states that Concept Australia must hold onto a client’s file and email records for 7 years before destroying it. Individuals have the right to request the deletion of their data where there is no compelling reason for its continued use. If you would like Concept Australia to destroy your email records or hard copy file before 7 years, please submit your request in writing stating your reasons.

4. The right to restrict processing

Clients can object to Concept Australia processing their data. This means that data can be stored by Concept Australia but not used in any way, for example to generate communications.

5. The right to data portability

Individuals have the right to have the data held by Concept Australia made available to other services.

6. The right to object

Clients can object to their data being used for certain activities. For example, for marketing or research purposes.

7. The right to rectification

Clients have the right to have their information corrected if they believe it is factually inaccurate.

Accessing and updating your personal information

As stated above you have the right to request a copy of the data Concept Australia holds as well as to request changes to your data if you believe it is incorrect.

Changes to this notice

We may change our personal data policy from time to time. This Policy was last updated in May 2018 in accordance with the introduction of GDPR regulations.
